What would be the likely outcome in australia courts?


22yr old, first offence, Pleading guitly to dishonestly aquiring a finacial advantage. $575 (which has since been paid back)
PUNISHMENT: custodial sentence,a fine and placed on probabtion.
I have been completley honest with my current employer who has kindly offered to write a reference for my lawyer for court.
Refernece from current employee who is aware of what happened in past employment - some words he has used in this reference: very honest but reserved person, trustworthy, honest, and also included in the reference that he is aware of the charges.
i went to the police station on my own free will and participated in a video interview in which i made full admissions to the offences. i stated that the first occassion was to see if i could get away with it (but what i meant to say to due to finacial reasons) - i think i need to speak t
the reason i did this was due to financial circumstances due to health issues. it was a stupid thing to do and i am very sorry for what i did.

(i never sed though that it was also to do with finicial reasonS) so i think i need to talk to my lawyer and tell him that?! i also explained that on the other occasions when i did it i began to feel guilty and stopped after the last offence. there are 7 all up. i have been told in the facts that i was very cooperative with the police and appeared genuinely remorseful for my actions.

so i`m just wondering what will be the finally outcome. im pleading guilty as i said. i know i ahve done the wrong thing and i`m truely sorry. its not something i would do. i have been really stressing about this and just want it to be all over. is there a possiblitly i could gett a custodial sentence. ?? i am hoping it is just a fine... what is placed on probation? is it bad??

Given what you say I am pretty confident that you will NOT receive any sort of custodial sentence so forget worrying about that outcome. Given your co-operation and references, I would talk to your defence about the possibility of requesting the Magistrate give you a section 556a which means the offence will be proven by the Prosecution, however you will not receive a conviction on the account of the circumstances ie. no conviction will be recorded to benefit you with future employment etc. At worst you will get a fine and/or a good behaviour bond. You obviously have learnt your lesson so that will go in your favour. Just be humble and there is a good chance you will get a section 556a. Just remember, crime NEVER pays!
