If an employee has left your employ do you have to give them a copy of their personnel file after they leave? |
An employee who was terminated is asking for a copy of their personnel file. I believe once their employment is terminated the employers obligation to the x-employee ends. The employer is not in suit with the x-employee so there is no subpoena of records. Nope. Your records, not theirs. Depends ENTIRELY on local law, and you didn't tell us where you are. yes, you have to give them a copy that is why you should never burn bridges. Unless there is a court order, you don't have to supply anything. Plus, if the next employer calls for a reference, you just let them know the truth.
