If he files for workers compensation, will my husband lose his job? |
My husband had a partial amputation of his middle finger, on the job, back in January. He has been seeing a worker's comp doctor weekly since, and has been on modified duty. Lately, he has been coming home and telling me that some of his superiors have been dogging him, watching his every move, and giving him a hard time. Today he said they are relocating him to a job site some 40+ miles away. We have an appointment with a workers comp attorney next week, but just to explore our options. I'm just wondering, if we decide to file for workers com, is it very likely my husband will lose his job once he's cleared to return to normal duty? If he does file, will it be difficult for him to find employment elsewhere? It is illegal for them to fire him for claiming workman's comp. If they fire him, they will state another reason. He needs to start keeping a diary because it can be used as proof later. Don't take it to work with him, keep it home. If they fire him, he will have cause to sue them for it. NO, Worker's Comp protects the worker and the employer - it is an insurance policy which pays for this kind of thing. And they CANNOT fire your husband after being hurt on the job. In fact they have to give him the same or reasonably the same job (after the accident). Actually an employer can fire anybody for any reason, it is whether or not that it is legal to do so ~ filing Unemployment and Workman's Comp ~ and maybe even considering sueing the company since he lost part of a finger. Good to get an attorney ~ they will steer you correctly. |
