I am going to a Employment Tribunal on Monday and am representing myself, I need to show my true loss?


with regards to earnings which is simple enough but how do I calculate future loss of earnings, loss of company car, compensation for mental health and loss of statuatory rights? I have had to issue a figure for the total I am claiming but the amounts for these 4 issues were approximate estimates. I do not wish to be humiliated in court so any help would be much appreciated.. Thank you

The grounds for going to the tribunal are following a 2 year period of unfair treatment by employer.. both managers and company.
Refused training.
Refused interview for promotion.
Verbal abuse.
Abuse of power by manager to ensure poor treatment.. etc etc etc

You have not mentioned why you need to go to a tribunal, it may be very relevant.

The tribunal hearing
The tribunal will inform you of the date of your hearing.

You don't have to appear in person, but you must tell the tribunal if you want the case to be heard in your absence.

When preparing for the hearing, ensure that you have all the documentation that you intend to use. It usually helps to consider things in date order to provide a sequence of events. If you're going to use any documents, you'll need to tell the other side, giving them at least seven days notice before the hearing.

At the hearing, you (or your representatives) and your employer put your cases to the panel and answer questions. The panel then comes to a decision.

You can take witnesses to the hearing who can give evidence to support your case. If any witnesses you would like to be there refuse to go, you can ask the tribunal to order their attendance.

You can represent yourself, and the panel will try to make things clear for you. The procedures are quite informal. There's no legal aid, but if you're a member of a trade union, they may pay for a solicitor. Some household insurers pay reasonable legal costs - check your policy documents. In complicated cases you can sometimes get help from Community Legal Advice.

Unlike other courts, tribunals don't usually order either side to pay costs unless they decide you or your employer acted unreasonably in bringing the case, or if any representatives at the hearing behaved unreasonably.
If you win
The tribunal can order your employer to pay compensation, which is unlimited for discrimination or dismissal on health and safety grounds.

For unfair dismissal claims the award is made up of:

the basic award (calculated based on your on age and length of service), and
a compensatory award, which has a maximum limit of 拢63,000 (although the maximum is rarely awarded)
For wrongful dismissal or other breaches of contract, up to 拢25,000 can be awarded.

Compensation is intended to replace lost earnings - there's no payment for hurt feelings (apart from in discrimination cases). You have to try to reduce your loss (for example, by getting another job or claiming benefit).

The tribunal can order your employer to give you your job back if you win a dismissal case, if you want it.

If you lose
You can ask the tribunal to review its decision, although the grounds are limited. It's also possible to appeal to the Employment Appeal Tribunal, which only looks at points of law (so you can't appeal if you think the tribunal just got the facts wrong). In this case, you have the right to legal aid.

i think the figures you have are probably ok if they are approximate estimates how else can you do it and the tribunal will realise this and adjust their figures accordingly if you win your case, don't forget to claim compensation for loss of pension too. good luck and remember just tell the truth as the legislation is stacked heavilly in your favour.

I would contact ACAS, they are the experts.

Have you had any contact with ACAS throughout the past weeks/months? Contact them, it may be too late in the day for them to intervene, alternatively speak to your local Citizens Advice Bureau and see what they advise.

A person who defends himself employs a fool. Get some sound advice. ACAS or CAB

As for true loss you cannot get this figure as you don't know when you would get a wage rise etc,
therefore an estimate is the only way?
my friends are just finished being at a tribunal they represented themselves and got shot down in flames by the panel who are usually ex lawyers etc.I am sorry I can't be of more help, so wish you good luck in your quest,.

A lot depends on the chairman of the tribunal. You should find him helpful to you as the whole system is designed to be non expert friendly.Don't worry about solicitors or lawyers for the opposition bullying you or making you look silly just be safe in the knowledge that the chairman will act for you to ensure fair play.So play nice.don.t be afraid to tell the situation exactly as you saw it and remember this is your chance to be heard so make sure you include everything.Don't leave anything out that could hurt the opposition.
