A nolle prosequi ruling was given, can a current employer change my employment status based on these charges? |
I was arrested on a minor drug charge for possesion of marijuana. In the time between my arrest and my trial my work put me on probation and would not let me work, being that it is a part-time job, I was recieving no income during this time. Now that my case recieved a nolle prosequi, my employer has agreed to take me back but as a result of the case they are placing me in a lower position resulting in me recieving less pay. Do they have the right to do this basing it on the fact that I was charged but never convicted or is there any case against them? If you live in an at will state, you are lucky you got what you got. Nope, there is no case against them. They have just as much of a right to put you at a lower position as they do to fire you. |
