Child support court order....? |
Filed child support on my kids father 4 years ago....i finally got word from my child support office that their was a child support court order on the way...question is whats next?...i called and verified his place of employment and updated that with his child support office (i live in Indiana he lives in Tennessee)...what is the typical time period until i start receiving some type of payment....after 4 years is this finally it? Trust it was 4 years ago...i am an honest person...hell if cheated the system i would do it in a way so i can get public assistance...i dont get shyt! If he contests anything, like paternity, it could be another 5 months before the order is in place, only because you two are in seperate states. But once he actually shows up and does the calculation worksheets with the cs people, it should only be about a month or two before you get your first check. Even though they finally have him, they have to contact his employer, the employer has to start garnishing, the money has to go through all the red-tape, account setup, etc. But once all of this is in place it will become a very regular thing so long as he doesn't change jobs every month, and you'll get checks the same days/weeks each month. Everytime he changes jobs, it will take about another month or two from the time he left that job, until the new job gets everything into place. So in this case you'll have a month or so where your getting nothing while the garnishment is being transfered to the new job. I only bring this up because you said he was in and out of jail and moved a lot. Unless he quits. YOu should be recieving a payment within 90 days Wow! They made you wait a long time. It should have started way before this. If you don't get it soon, go to supportkids.com. You have a ways to go, if you have a court order filed in Tennessee then they can attach his wages, but when that happens they usually just quit the job then you have nothing to attach! Most times, it's smart just to move on and not waste your time and money pursuing it! the system doesn't work for the honest people im not sure in your state but in washington it can take up to 90 days after they have place of employment sometimes the state will hold the check i dont no why . you will also get a large check at income tax time for back child support. where ever you guys got divorced, or gave birth to kids is where you will have to open a court case. he will have to be served paper and show up, his income will be verified thru the courts and payment should be immediate. I don't understand all the delay... You couldn't have done this 4 years ago?? !! Through the court??!! Good Luck. |
