What recourse do I have if my employer payed me less than others and gave no explanation as to why?


I worked for a major retailer and during my employment there, they paid me less than what others were paid doing the same job and working under the same conditions as I. My sales were just as good if not better than others. All other employees were paid at the same hourly rate, but my pay differed.

My employer never gave me a valid explanation and I wish to be compensated for the amount which I was not paid. I was reading EEOC.gov and thought I might have a case against them.

As you look at your situation from your individual standpoint, there are a few key factors which may come into play, with your situation. Before acting on a decision you may be considering moving forward on, consider ONLY facts that relate to your personal status as an employee. In other words, try looking at your job performance, length of time of experience, any absentees, tardiness, and customer relations. These are some of the key factors which play a vital role in one's continued employment and promotions relative to their paycheck. However, from the eyes of your employer, there are outside forces which play an even more critical role which determines, not only your paycheck, but all other employees paychecks as well. And the Margin Of Profit, or what is referred to as the bottom line, is far greater important to your employer than your personal situation. I know it sounds cold and heartless, but that is the business environment inwhich we all live in today's business world. In the event you are unhappy with your present situation, you can address your concerns directly with your supervisor, and see if there are any changes made. Or you may need to seek out another job, within the same field, with another employer. The latter of the 2 is always an option, rather risky in today's economic conditions, but an option just the same.

In the UK.....

Look at your contract of employment and see whether your pay was as agreed, and that it was equal to or above the National Minimum Wage..

How do you know what the other employees were being paid? If it was more than you, was a part of their pay accounted for by commissions, increases for length of service, or other factors that may not have applied to you?

If, after considering these questions, you still feel that you were treated unfairly, you can raise a grievance by sending their Human Resources department a A Step 1 Letter asking for a written explanation.

If they fail to reply, or send you an unsatisfactory reply, you can take matters further. To find out the Grievance Procedure, look at the Citizens Advice website as below.

If you agreed to work for the wages offered then you don't have much of a case unless you are a minority and can claim that is the reason you were paid less.
Sorry you weren't treated fairly. Sounds like you need to speak up and be prepared to leave if they don't fix the situation.

Go to a lawyer and see if you have a case.
you may have been paid less due to less time on the job, or some other reason.
Good luck finding a lawyer for this type of case, it's not cheap.

I ran into a similar situation once. This is pretty much how it goes.

Your company has a right to pay you whatever they want as long as it is above minimum wage. You have the option of quitting so as long as they are paying above minimum wage you can't do much.

however if you believe they are doing this because your race, religion, age or gender. you may be able to say they are discriminating against you.

IF you are a white male your pretty much screwed because your not protected.
