What is the legal procedure. kindly advice? |
My father is a retired employee . Before retiring from the serivce he put a guarantor sign to his Co - worker to get a loan for Rs. 80,000/- in society.the co-worker eloped from the employment and not retrun back for the past 3 years . the society appoint a Atribator (Advocate) he sent 1 notice to us & the borrower to pay the amount before 6 months. immediately we went to his native .there his father said that we will pay the money and replying to the notice - that they are taking liablility to pay after reemployment of his son.After that the advocate send a 2nd notice. but it was not received by us again now the advocate send 3rd notice in that he stated awarded a rule -Rs. 170000/- ( including12% interest)to be paid jointly or severally with in 15 days fail to pay attachment will be done. in the 3rd notice he stated 2nd notice sent to us is insufficient address. also he stated Ex party absence it was awarded. so we are in confusion. kindly advice us what is the procedure to do. If you think you are in confusion, you should see me after trying to figure out your question. |
