Employment law questions- job as employment law consultant?


If you have an employment contract which is signed by both parties do you also need to have the contract witnessed in the witness section of the contract?

How feasible is it to obtain a High Court Injunction to prevent former staff poaching employees and dealing with clients?

Fairly simple questions:

1. No, the contract does not need to be witnessed to be valid, even if there is a section for a witness (which I've never seen).

2. Perfectly feasible if there is a valid restraint of trade clause and there is evidence the former employee is in breach of it. The High Court has dozens of such applications at any one time.

If there is no clause or the clause is struck down by the court as being unenforceable, then there is nothing to stop poaching.
