Attorney has ignored me, and now my deadline is up! Employment law and WC question??


I hired a workers comp attny last year to cover an injury I received on the job. Not much happened over the first six months other than going to see doctors and getting medications. It was obvious that I was terminated due to my inability to work so I decided to sue for wrongful termination. When I spoke with the dept. of labor, they told me I was too late. 180 days was my time limit. My attny. never explained this to me, ever! I did receive a "right-to-sue" letter and when I had enough cash for a consultation w/ an employment law attny, I went. At the consultation, the EL attny explained that my deadline for filing a complaint with a RTS letter was 90 days. I was one week away! Fortunately, he told me that it would only take one day to file the complaint, but first, he had to determine whether I had a winning case or not. At that point, he said I had a 20-30% chance. Not too good, but he'd do some research and get back with me. He never did. I left several messages and even spoke.....

with his secretary who assured me that she would have him call me back. Again, he never did. My 90 day deadline passed.

That was back in Nov. and I just received a bill for $200 for his "services rendered" or research that I never heard about. My wife is no skeptic, but seems to think that my former employer, being promanent in my city, is involved somehow. That my attny's aren't working "for me".I don't know what to do anymore, or who to trust. Is there any recourse to these actions?

Contact the state bar association. They will be able to give you some advice.

Why dont you talk to someone about a attorney/client misrepresentation suit---------in otherwords your atty. failed to represent you according to the best possible means of doing so.

lady i don't know what state you live in but i would get a good d@m lawyer because these peoples is not working for you . you still have a good case if you got hurt on the job file a complaint i sure you have a case with a good lawyer . i have been their done that before myself. i want say good luck you want need it with a good lawyer i'll just say get paid.

Sounds like your attorney screwed up. He should have filed a Notice within the time frame, then got the research underway. Do not pay his bill. Bar B*t*ch him. (report him to the State bar).

The thing that really sucks about your situation is that you stated that you had to wait until you had enough cash for your consultation. Im assuming that means that your pretty down financially, which is understandable in your situation. Unfortunately, in order for any attorney to take a case like this, you'd probably have to come up with a pretty hefty retainer and be willing to lose it all, and then some! The Barr Association can't help much either. They usually don't deal with law suits. Sry about all you're going through. I wish you the best.

Did you sign a retainer agreement or did you just pay for a consult?

Something doesn't sound right. Attorney's like any other business want to make money. So it seems strange that the attorney would do this. Maybe he is right and you really don't have a wrongful termination case. Calling is obviously not working so can you travel to his office to physically see him? If you go he will more than likely see you at least to explain the situation and not want an angry client in his waiting room for potential clients to see.

Attorney's don't go through law school and take the bar all to have complaints filed against. Maybe there is some miscommunication. Nonetheless, take your bill and retainer agreement to the RTS (I'm not sure what RTS is though) and ask for an extension and see if you can file the complaint and explain you were under the impression your attorney had filed. There may be a provision that allows you to still file under certain circumstances.

Also, take all your paperwork to consult with another attorney or legal aid (the State Bar in your area will have the number) to see if you can get some assistance, and possibly a deeper understanding of what went wrong with the attorney.
