Attorney has ignored me, and now my deadline is up! Employment law and WC question?? |
I hired a workers comp attny last year to cover an injury I received on the job. Not much happened over the first six months other than going to see doctors and getting medications. It was obvious that I was terminated due to my inability to work so I decided to sue for wrongful termination. When I spoke with the dept. of labor, they told me I was too late. 180 days was my time limit. My attny. never explained this to me, ever! I did receive a "right-to-sue" letter and when I had enough cash for a consultation w/ an employment law attny, I went. At the consultation, the EL attny explained that my deadline for filing a complaint with a RTS letter was 90 days. I was one week away! Fortunately, he told me that it would only take one day to file the complaint, but first, he had to determine whether I had a winning case or not. At that point, he said I had a 20-30% chance. Not too good, but he'd do some research and get back with me. He never did. I left several messages and even spoke..... with his secretary who assured me that she would have him call me back. Again, he never did. My 90 day deadline passed. Contact the state bar association. They will be able to give you some advice. Why dont you talk to someone about a attorney/client misrepresentation suit---------in otherwords your atty. failed to represent you according to the best possible means of doing so. lady i don't know what state you live in but i would get a good d@m lawyer because these peoples is not working for you . you still have a good case if you got hurt on the job file a complaint i sure you have a case with a good lawyer . i have been their done that before myself. i want say good luck you want need it with a good lawyer i'll just say get paid. Sounds like your attorney screwed up. He should have filed a Notice within the time frame, then got the research underway. Do not pay his bill. Bar B*t*ch him. (report him to the State bar). The thing that really sucks about your situation is that you stated that you had to wait until you had enough cash for your consultation. Im assuming that means that your pretty down financially, which is understandable in your situation. Unfortunately, in order for any attorney to take a case like this, you'd probably have to come up with a pretty hefty retainer and be willing to lose it all, and then some! The Barr Association can't help much either. They usually don't deal with law suits. Sry about all you're going through. I wish you the best.
