Employment law question?


I have a question regarding salary. My boyfriend's company is screwing him over, and I'm curious about the laws on this. I know it can differ from state to state. I鈥檓 just wondering about generally. We are in AZ, if anyone is familiar with it more specifically.

First, here's a little background on the salary issue. When hired, employees were given an option to sign a 1-year contract. Those that sign are given $27k/yr evenly per paycheck. Those that don't sign are given $18k/yr then $3k at 6 mos. and $6k at 12 mos. Recently the company said the contracts were not legally binding, and they did that to keep people around. No one is obligated to stay a year if they signed a contract.

My boyfriend did not sign the contract. It seems to me that those who did not sign the contract should be given enough in one lump sum to catch them up to where the contract signers are (in proportion to how long they've been there), and everyone should get paid the same amount.

The company is trying to pro-rate the bonus evenly over all remaining paychecks until they reach their one-year anniversary.

If they do it this way, if they were to leave before the 1-year (and being caught up with the bonus), they would end up receiving less than those that were paid the even amount all along. They would have to fight for the remainder of the money they鈥檙e owed when they leave, which I can guarantee they would refuse to do. Does this make sense to everyone else, or am I off base, here?

If you didn't sign anything, you don't have a contract. Promises made without a signature are worthless.
