Employment agency and breach of contract?


OK, I was given a conditional offer letter for a job which I signed and returned. I then decided I did not want to go ahead with it, however I had not satisfied the conditions of the offer (i.e. provided adequate references and work history).

Firstly, would they and can they successfully sue me?

Secondly, if the recruitment agency has told me that the company won't sue me, but he is going to make sure they do by sending all confidential emails between myself and him to the company, is the agency breaking the law?


Any help or advice would be greatly appreciated.

If the employment agency (you employed) has a agency/client confidentiality clause, then the agency is breaching their own contract policy. If they don't, you can consult an attorney to see if your communications (e-mails) with the agency should be construed as confidential in order to have open and truthful conversation with the job counselor assigned to you.
