Texas employment laws - Does an employer have to pay you the sick time that you have accumulated upon discharg


At our facility we "earned" approximately 2.5 hours of sick time during each two week pay period. Since this is earned time does the employer have to pay this out to you upon discharge? Would it make a difference if you were fired or left voluntarily?

I believe the only Texas law which would apply would be the FMLA law. Your employer normally has written company policies. These would be your guide to these questions. If you are fired or left voluntarily you may not receive any benefits which have accumulated. Ask your employee for current employee benefits concerning medical leave. Go to the Internet and look into FMLA laws. It only applies to individuals who have worked for 1250 hrs and are full time employee and it applies to only certain family members with serious illnesses.
