Pre-employment drug test?


I got a job as a security guard for a private security company in NJ....they told me that i have to come back tomorrow to take a drug test in the office.....Is it even legal for them to make me take a drug test in the office and not in a lab.....also can my employer come in and watch me give the specimen????Serious answers only please. Thanks

Yes, they can ask you to do whatever they want. They can't openly discriminate against people by race, religion, age or gender. But drugs...no protection. They could ask you to pee in a cup in the middle of the HR person's office. If you don't want to do it, find another job.

i dont believe they can watch you give the specimen they should send you into the bathroom too piss into a cup

They should not watch you that is a violation of privacy. I do know when you are joining the US services they watch you when you take your test.

I don't know if its legal or not, but if you are worried about marijuana, check out a product called Minute Man.

If they have a registered nurse at their facility then, yes, they can but only the nurse can be in the room when you pee. You never know, they might simply take a hair test.

they more than likely have someone collect for you but when you fill the cup you will be alone no one is going to stand over and watch you...you just can't flush..

Usually they make you go to a local Doctors On Duty type of thing and do the text there since a nurse or doctor can only legally determine whether or not it's any good...I would contest it.. that's bull!!!

They can only make you take a test after offering you a job. If it is in the office there should be some kind of formal collection device. He should not have to come in the room with you. If you feel uncomfortable, ask to take it at a lab or some medical office.

I think they can specify whatever they want (however, every state has different laws). The person watching you should be the same sex as you.

I've given drug tests as well as taken them (I work in healthcare). Every hospital I've worked for has done their own testing. As long as they have an adequate chain of custody it should be OK.

its a private company,so they can make their rules-i dont know about your employer watching tho.drug tests are so anti american in the first place-i mean if your too high to do ur job thats 1 thing,but in your own time?thats bordering on communism-the big brother thing

Yes, they can ask you to take a drug test. And don't be surprised if they spring one on you randomly. It is becoming more of a standard for companies to ask for drug testing. And also it depends on what job you have. If you are going to be in security, yup, you will be asked to do more than just this once.

If the company has a person trained to perform drug testing (actually they aren't performing the test, just the collection) that's fine but I'd rather see you go to an independent location such as an urgent care or other facility that does many collections a day and is fully trained in specimen collections. If they have a healthcare professional and/or drug screen collection process on-site that person can perform a test but different states and different jobs can have separate requirements and I'm not 100% sure of New Jersey's related laws. I worked for a large national laboratory and trained employees in the collection of specimens for drug testing. You didn't say if your job is for federal or non-federal drug testing, which can have different requirements but what we used to do was put a blue chemical in the toilet, have you put your valuables in a safe place (so you couldn't smuggle anything into the bathroom), turn off the water, ask you to collect your urine specimen and come straight out of the bathroom without washing your hands or running the water (some bathrooms don't have a cut-off switch so we'd put tape across the handles and faucet). The collection person will take the temperature of your specimen quickly and will know when you hand it over if it's warm or cool to the touch. We were NEVER allowed to watch the patient collect the specimen. Good luck!

Yes they can. i used to work in the lab and test people for drugs, this is nothing aganist you, it's just if they suspect one they must check everyone . and this is done at random so people can be more easily caught. and yes they can come in and watch, this is usually how most employers do it. but that person has to be of the same sex, you know a man can't watch a woman and a woman can't watch a man. be advised that if you don't want to submit to the drug test that they can also terminate you and it's legal. Try not to let it bother you, there are so many people on drugs that they have to do this, also keep in mind that most employers do this more toward the holidays, i've heard of a lot of people loosing their jobs right before christmas!! good luck!!

I'd tell them that they can take their job and put it in a little jar. Enough is enough, this kind of treatment is unjustifiable.

Funny, the higher ups in the orginzation never get subjected to this kind of humiliation.
