Do pre-employment personality tests violate a person's rights?


Companies like outback steakhouse use personality tests to find the composite employee. It is legal but my question is can they be challenged in a court of law on this? If so on what grounds?

Companies are not required to hire you for any reason UNLESS they are bound by affirmative action laws. This would only occur if the state in which the company operates is an affirmative action state, and whether or not the company is receiving state funding. Otherwise, the only things employers can not discriminate against are race, religion, sex and age. They can choose not to hire you because they don't like your hair, because they don't like your shoes, or because they don't like your personality.

Discrimination if they don't hire you based on the results. Other than that, if you signed permission for them to test you, there is nothing you can do.

In a business where one meets the public it would be nice to have people with the right kind of personality. Those tests are very common and very legal. Results are kept confidential so you don't need to worry.

They can discriminate based on stupid reasons, just not illegal reasons. You would have to show that the test's purpose or effect was discriminatory toward a protected class (race, sex, age over 40, etc). Good luck with that.

That would depend on if you got the job and what job you are applying for. Talk to a lawyer about this(one who deals with work laws). Don't be too rash if you haven't been denied the job. Of course any employer wants employees who deal with the public to be good representatives of the company. You don't want someone out there who's a hothead, or a loose cannon where the public will see them loose their tempers.
