Laws regarding employment verification in California? |
My son, who was laid off in May has been looking for a job. I noticed that he is not receiving and proposals for work although he has gone on many interviews.. A friend who was going to thire him called his old job for verifiation and the old employer said that my son was a bad apple , that no one should deal with him, he lies, he steals, etc. I thought in California there was a law against this? The only response a previous employer can legally give to a prospective employer is a yes or no if the employee is eligable for rehire. The bad thing is trying to prove this in a court of law. You would have to find a witness that would testify that the previous employer was in fact bad mouthing the former employee. If your son did in fact lie, cheat and steal from his former employer he's lucky the employer didn't file charges against him. If he didn't, and you can prove the statements as false, and you have a witness then try contacting an attorney. yes there is it's called slander even if it is true they can't pass it on. Also there are federal laws against blackballing some one,which seems to be the case here. |
