Have you taken an employer to an employment tribunal for unfair dismissal?


can I have some feedback from anyone who has been in this situation, whether you won or loss

I have asked because I am going through one now with my Part-time employers. I was wondering how common it is. The Union has been useless and i was wondering how much real protection there is out there for employees from corrupt directors.

In most of these cases, the employee has the upper hand, and rightly so, and unless the company can prove bad things about you, then you ought to win.

Unions are nowdays, I'm afraid to say, as much a part of the ar*se licking establishment as the bosses, they have a, we want it to, and screw the workers, attitude.

Go present your case, with all the relevant facts, and where you can get other employees, past or present, to speak for you, supporting your claim, then the chances of winning are hugely increased.

Blimey now you have taken me back .. 34 years ago i took my employer to the tribunal for insisting i did continual overtime (i lost the case because i did do some overtime) but not enough for my employer... to this day i still cannot understand how i lost, i thought overtime was voluntary.

Going through one now - really hard work and wonder if it will be worth it, Why do you ask??

I did take preliminary steps and was looking forward to winning hands down and subjecting my employers to a great deal of adverse publicity, but they wisely settled out of court at the maximum pay-out available at the time. Irritatingly, this maximum went up dramatically the following year, but that's life! More employers settle out of court than people realise. It saves them lawyers' fees, costs and humiliation.

A lot of it depends on what the issue is and how good your legal representative is. In these situations it is no good just saying my employer was wrong, these are the rules.

You need case law to support the argument. It depends on how much experience your legal advisor has and how much work he is prepared to put into preparing your case, if indeed there is a case to answer.

There are a number of common law rules that weigh heavily in favour of the employer.

As you do not state the problem it is difficult to help you.

I have done it. In my case we settled before the tribunal hearing. I reckon I 'won' as I certainly gained a sum of money I would not have had otherwise.

What is the reason given for your dismissal and how long have you been employed by this company?. Both these factors are important before you decide to take action.

Also I'd like to know why you think your company director is corrupt. If that is the case and you have proof you could take further actions.
