Does an employer have the right to terminate your employment if you get hurt on the job?


iwas put on a perminate restriction at work and sent home because i can not preform one asspect of my job now this is a very large company it employes 5000 of its own employees and have 900 temps, what i need to know is can they throw me off work while haveing a temp employee in a position that i can physicaly do?

this is a shoulder injury and the perminate restriction is no over head use of the right shoulder now i know there are job there that i can do and they are held by temp employees, i am an employee of the company not a temp.no compinsation has ever been given and i realy dont wish to get any i would just like to be able to go back to work

In Michigan we have at will employees, companys can fire you for no reason at all. Only thing that can stop that is a union contract. However that gets abused and many an employee that should be fired isn't becuse of the contract.

If you were drunk yes.... With out reasonable cause they can not do that. Better get a lawer.... its time to sue.

if you're a already a regular/permanent employee, an employer has no right to terminate you if u get hurt while on the job. however, u did not mention details but i would suggest you consult a labor lawyer to know your rights :-)

Some employers are "at will" employment, meaning they can fire you without giving you a reason

If the company can prove that your performance is "inadequate" then they can let you go. If you will no longer be able to perform the duties that you once did, they can probably let you go. However, if it's workers comp, you can sue for money. You should probably contact a workers compensation attorney to see what the options are for you in your state. Good luck!

heck no!!! thats against the law, read the bulletion board in your break room, the laws for workmans comp should be there if not then ask your employer. thats so illegal. workmans comp protects you from that. and unless its paid leave they cant fire you!!! get you a lawyer i smell money

You could try the ADA if you want but they are about useless. Did you receive compensation for your injury? If you were hurt that bad that you cannot do your job you should have got a lot of compensation for your injury

You can be fired for anything, they usually give a period of time for recovery, but then if you still cannot perform what use are you to the company?

check with a lawyer or the civil liberties union, do you qualify for workman's comp?

Almost all employers would rather have an employee work than go on workers comp and raise their rate. Non work related injuries are handled differently.
You should tell your manager/HR rep that you don't want to file workers comp, but you will have to in order to survive. I suspect they will place you in a position that will allow you to work.

Barring a contract or policy to the contrary they can normally place who they want where they want, temp or not.
