Work Choice Inductrial relation apply to retail? need help for current employment?

I'm confused,

Been reading the new work choice legisaltions.

It says that oganisations with 100 or less staff can immediately fire someone.

Just got a new job at polo Ralph Lauren and they explained there dismissal procedure.
they have 3 prior warning to getting the sack.

Are they just being fair? what haven't they adopted the new changes?

Just because the new IR laws say somethink it does mean that an employer has to use them they can have individual agreements and there are still some people employed under state awards.
