Isn't it against your human rights to be refused full time employment if you have a moustache?


I have a friend who applied for a job doing maintanence at a gym and the interviewer told him it wasn't there policy to hire someone with facial hair. He wears a moustache because he has a hared lip and with out it he is ugly. It is his right to wear it so why should he be discriminated for it?

Facial hair is not a right, well maybe it is, but it is the employers RIGHTS to refuse employment.

You can look however you want, but employers can require a "dress" code including such things as tattoos and piercings not being visible to the public.

Tell your friend to shave or go somewhere else to work.

That's messed up. That really is.

It's not any violation if it's a standard policy that's not based on race, religion or national origin.

It is the right of any company to hold a policy such as that. Afterall, it is not discriminating against something that cannot easily be changed.

This is a private business. If you friend wants the job he needs to shave. Some companies do not want facial hair and they have every right to ensure that.

It is not his RIGHT....the company and many others have that type of policy....Disney Corp has that policy and Walt could not have worked for them today if he refused to shear off the stache....

It is legal to refuse facial hair for safety or dress code reasons if facial hair poses a safety risk for that job but in general, it could be considered discrimination depending on the circumstances. i would check your local employment standards act and human rights comission. If you are in canada you can get that information at...

Does the Commission take complaints about dress codes?

At the federal level, dress codes do not violate the Canadian Human Rights Act, unless, for example, a dress code prohibits an employee from wearing an item of clothing or a piece of jewellery required under the tenets of that employee鈥檚 religion. Your friend may be able to file a complaint based on the fact that he has a hair lip( cleft lip) for which reason he wears the moustache.If I were him, I would call the office for the human rights comission and talk with an agent before making a complaint to be sure of his rights in this particular circumstance.

You may have to call the office for exact information on whether that particular circumstance of refusal of employment was legal.

Perhaps he was letting your friend down easy so as not to hurt his feelings.

It's his right to have a moustache, and it's someone elses right to hire people who adhere to their legal policies.

It is part of the dress code. Therefore they can mandate the code as they please. Just like people with piercings or tattoos, must remove them or cover them up in order to work. They even have the right to say that you must have a drivers license in order to be eligible to apply for a job that does not require driving (even though not everyone is allowed to drive, but are capable of doing the job)

no; it's unfortunate, but employers can hire whomever they like and set rules such as facial hair, piercings, etc. Your friend is not being discriminated against; that's simply the way it is.

if he was working in the food industry, then yes I can understand the policy....but maintenance.....give me a break. That is like saying that a women, who is not in the best of shape, can not work at this gym....come on...contact the employment rights commitee...it is found in the blue pages of the phone book. The labour board would find this one to be interesting enough to investigate the policies of this gym. Which by the way, the investigators for the labour board are actually lawyers. He is not being discriminated against. The company has a policy against facial hair. They won't hire him unless he shaves. His choice is to shave and get the job or don't shave and not get the job.

There is nothing discriminatory about that. The choice is his.

I wish that were true. Disney won't hire anyone with facial hair. No one has brought it to legal terms but they even made performers who normally had beards to shave them off.

Well most places that don't hire due to facial hair is the food industry for obvious reasons. I have a lot of tattoos and because of it i don't get a lot of jobs because it doesn't look professional but i knew that when getting them so its all on me. A job can refuse to hire someone if they are violating company policy. Now if they don't have it down as company policy in their rules and regulations book then its possible they may be discriminating its hard to say. But for the most part a company can decide not hire someone for facial hair, piercings, tattoos, and several other things without it being discrimination, because those things fall under the "professional" worker look. There isn't much chance for a lawsuit there. What your friend could do is shave and then try to get a job there and if they don't hire him because of his lip or whatever then its quite possible its discrimination

More important it is against his Constitutional rights, in America. Get a lawyer and sue.

Yer that sounds wrong. He should consult with a lawyer
