Hitting an elder? |
Ok let's say a teenager is in a fight with another teenager and an elder, say around 80 ( a very agile one), gets in the fight and starts kicking and pulling the hair of one of the teenagers (I guess to help the other teenager out), is the teenager that is being hit by the elder (and the other person at the same time) allowed to defend himself against the elder and hit or try to push the elder away, so he doesn't end up being killed by both of them, or will he automatically be punished by law if he was acting in self defense even if the person is an elder? Sorry if this sounds confusing, just trying to put all the details in. Thanks ok for Barry C, if you would have read the question, you would realize that it's the teenger and 80 year old against another teenager. Why don't you read it again and see how stupid you sound. Self-defense has nothing to do with the age of the parties involved. If you are being attacked by an 80-year-old, you have no means of retreating, and it is necessary to use force to protect yourself, self-defense is still a valid defense against battery charges no matter what the age of the person you defend yourself against. Thats self defence if you hit the old timer, if she's or he is going to put themself in a fight and punch up a teenager then she/he deserves a smack, i know your suppose to respect your elders BUT not if they are going to do things like that ... The law would probably see the fight as two separate situations, there is the first fight involving to two teenagers, then when the old timer jumps in, that is an attack - and it all depends who hit who first - but thats clearly self defence if you hit the old timer okay, well if i was the teenager being hit by the elder, heck yes i would defend myself and hit the elder back! The elder is still a person and human being, she/hes not a puppy dog or a pet. i mean, they were a teen once and stuff. i mean, i guess depending on whos the good person and bad, but i mean, i highley doubt that someones just gonna let a grandma or grandpa start kicking their butts and pulling their hair and stuff. I would defent myself. 2 teenagers against an 80 year old guy.....you should be ashamed of yourself. If you could not get out of his reach you are truly pitiful. You deserve a good caning. You are always allowed to defend yourself with reasonable force. Obviously you can't take the oldie out with a crow bar but you can defend yourself and administer sufficient force to keep yourself safe. If the old fogie is attacking the teenager the teenager can break every bone in his freakin body. well... they could try to get away from the elder but if injured either party could sue becuase of assult. (expetually if they are strangers.) I get what you mean. No, just because someone is an elder doesn't mean they can charge you for hitting them if you feel threatened. Yeah, you should give that elder a right cross and then a straight body shot in the solarphelxus!!! he wont be punished because he is defending him self, P.S. good question i believe in low 100%...but sometimes we can not control our reactions...and it depend on how much is the defrense in age?? |
