Do I have to legally appoint a next of kin or is it just granted ?


To choose my younger sister as my next of kin, over my elder brother, would I have to legally appoint her through a solicitor, or can I just choose my her and thats it?

Reason I ask is that I am not sure if a persons age takes precedence?

Anyone know ? :o)

I have a will, my sister is named as the executor, but is this enough to give her legal backing as a next of kin?

Find out the need as existent in your place of residence specifically there in Scotland. Things differ from one location to the next inside a country; and so we can assure that laws differ in each country throughout the world.

Don't guess on this. Guessing can lead to great errors and later real and true cause for alarm that can be on-going and considerable unrest and unhappiness.

Do know this -- family can be among the most grave of enemies, whether by willful intent or negligence. And this is true no matter what part of the world you live in, because the hearts of human beings bear few surprises.

So do find all this out with exactitude and inform all of what is your determination well ahead of time such that none is shocked as to feign hurt or ignorance as basis to proceed against some one else or even you: you just don't want that sort of poison infused into your life or that of another's.

Don't ever assume that something just happens with the law, people try to fight the most clear cut laws all the time.

If you would prefer to have your sister be appointed as your next of kin, this must be in written in legal documentation. Most likely in your will. Is your sister at least 18 years or older? If she is not, then she cannot take the next of kin because she isn't considered a legal adult. even in wills where the next of kin is named to the children, the assets being left are put into a trust account for the children until they are 18 years of age.

to be honest you woud be better getting it put down on paper any thing you want doing as it saves a lot of arguments and it makes it easier for the people you leave behind and also makes certain that your wish,s are carried out the way you want them to be .it only costs about 拢30 to make a will and it does make things alot easier for your family /relatives as otherwise any one can make a claim against your estate and people who you dont want will get some of your stuff .you can always change it later on if you want to .

The ages of your brother and sister have nothing to do with anything, if you die without making a will (Intestate) and you are not married or have children your estate will be divided equally between them.

So the answer is easy, if you have a preference, make a will, you can go to a solicitor, buy one from WH Smith or do it on line.

Making your sister executor gives her no legal right as far as next of kin is concerned, MAKE A WILL!
