If two people are together before the elder one turned 18. Can the younger one file a lawsuit?


like say they were a year or two apart. They got together before the elder of the two turns 18. Can the younger one press charges to the elder one because the younger one is now considered "underage"?

or is this just silly?

No sex is involved.

That depends upon several things. It depends upon what you mean by getting together. It also depends upon which charges are brought. Further it depends upon the local laws. I suggest talking with local lawyers or law enforcement. If they got married, then that changes things as well. No one who is married is treated as underage except regarding such things as alcohol consumption.

No sex involved usually means that no sex related charge can be brought. Other things might such as a variation of corrupting a minor. If the age difference is so close, that one won't go very far. I suggest talking with your parents about your wishes and perhaps local authorities. Revenge is not a good thing.

I don't see acceptance or rejection of a proposal of marriage as a cause for legal action. Should false claims be made or similar circumstances come to pass, then that would be cause for action. There is a difference between changing your mind and playing someone for a fool. One is legal and the other is not.

Thanks for the information. Breech of promise should not be a concernt yet. The boy is not old enough to be held to an engagement without parental and court approval. That's a local law which will vary from place to place. He's young enough that most places won't allow legal action against him regarding the marriage proposal. Since he is off the hook, so is she. He cannot bring action against her because she cannot agree to marry him...yet. There are circumstances which will allow for legal action, but those usually involve breech of promise, false representation, sexual activity and/or pregnancy or not being legally able to perform promised actions such as agreeing to marry. Age is tricky. Laws are tricky. Unless someone is out to get the other I see nothing in your described situation to worry about. As an example, in OK underage girls and boys can marry if there is a pregnancy AND with parental and court consent. The alternative is jail because both of them broke the law. It depends upon the judge.

Yes, any relationship involving two people where one is a legal adult and the other is a minor can lead to statutory rape charges . Some states are more strict about this than others though.

I do not believe so cause there is not a 4 years over the limit involved.

Most defiantly not. If they're both minors the charges would be thrown out of court!!!!! Only an adult can be penalized for having sexual relations with a minor. Don't fret. :)

Filing a lawsuit is NOT the same as pressing charges.

That said, if the older person is wise, he/she will terminate the relationship.

In my state any interested party ... family member or friend could inform the police of a statutory situation. The police would then press charges.

There are alot of laws, which vary by state regarding relationships and sex for children under 18, but if you two have been together for this long, I would not be concerned unless you have forced yourself upon this girl (date rape)

I don't know of a jurisdiction where a minor can be held to the terms of a contract unless it is reaffirmed after obtaining the age of majority. I'm speaking only of a civil matter here. Based upon the facts presented, I hardly think that I would lose any sleep over it.

The law varies from state to state. In New York, you're just a mite away from the threshold (four-year age difference) for felony misconduct with a minor, but the misdemeanor charge might stick. She might get 30 days of community service. You, on the other hand, would stay in Juvie until your 18th birthday, since the conclusion would be strong that you were neglected. Might do you a world of good to see that there are limits on how far a punk can manipulate the system.

They are a year or two apart? How many is it because yes, depending on the State and age there could be problems. Especially at the age of 15. And if the parents press charges the older one can end up in prison and forever be listed as a sex offender/sexual predator. Especially if it was just a casual relationship.

There was just recently a case like this in the news, here in Illinois at least. I think the guy had already been in prison for a few years. The affair had happened when both of them were minors something like she 15 and he 16/17. But then a judge decided that this had just been a romance of two consenting minors and that the by now long turned adult man was definitely not a sex offender.

In your case, if the 15 year old was a boy, I don't think you have to worry, he won't get pregnant or run to the parents and tell them, he did it.
