Trying to get clarification regarding elder abuse?


If a landlord evicted a tenant who is elderly, because of paperwork, and the elderly tenant became homeless, would this constitute elder abuse?

You really don't give enough information.

But if you know this elder, and if the elder is in California, please try to get them help through Adult Protective Services or through the Victim Witness Program which deals with Elder Abuse.

Thank YOU for caring about an elder! It is a fine thing you have done taking action on behalf of an elder who is unable to take action for themselves. We need more people like you.

I don't understand "paperwork" being a cause for eviction. The tenant needs an advocate to represent and assist them. Any elderly person who is homeless because of eviction is being abused in one way or another. Get help! Try Legal Aid.

It depends. If the woman didn't pay her rent or didn't provide proper documentation that EVERY tenant by law needs to provide, then there is no elder abuse. Being homeless affects anyone. Housing is for everyone. Just because someone has a disability or is an elder, does not mean it's abuse. If it were the case, than eviction itself would be abuse. Discrimination happens when one specific group is treated different or has a different set of rules from everyone else.

If the woman is evicted and was not given any notice and a writ was not done and the Sheriff's department didn't get involved with the eviction, than the lady needs to seek legal counseling and help.

NO elder abuse is like child abuse. It is physically abusing the person like a child abusing the parent. If the elderly person was not evicted legally then the landlord can be held liable. But if the paperwork was not completed or if the person lied so they had to be evicted then the landlord was justified. He/she needs to protect their investment just because someone is elderly, pregnant, or has children does not mean they have the right to stay in an apartment
