Can a lawsuit be filed against several organizations at the same time?


My aunt lives in a HUD seniors鈥?building in FL; the on-site manager has been psychologically abusive to her: she has threatened to raise her rent & has intimidated her in other ways. HUD doesn鈥檛 have jurisdiction over such abuse because there is no federal law which covers elder abuse. There is, however, a state law which does: it requires the owners of the building to post the state statute on a common bulletin board notifying the residents of their rights on elder abuse. The owners of the building have not done this, &, it is my understanding that the owners don鈥檛 even know such a state law exists. Other than the owners & the on-site manager, there is a third party involved: the managing agent. This is a corporation that is supposed to oversee the on-site management, but they aren鈥檛 doing so. The managing agent does not take the complaints about the on-site management seriously. Is it possible to file a 鈥渃ombined lawsuit鈥?against the owners, the managing agent, & the on-site manager?

Generally speaking, you can name multiple defendants in a lawsuit when the complaints/allegations are fundamentally the same and the same court has jurisdiction. If you are pursuing federal law on one thing (e.g. HUD regulations) and state law on another (e.g. state elder abuse laws), that is different jurisdictions and different suits.

You must get an attorney licensed to practice in the state where the plaintiff lives (i.e. your aunt -- therefore FL) who is experienced in these matters. Nobody can address your specific questions and specific situation but an attorney in that particular state. You might be able to get an attorney who will accept this case on a contingency basis (collecting attorney's fees out of the damages settlement), but you should still be prepared to pay initial consultation fees, and perhaps a retainer and/or court costs and filing fees when searching for an appropriate attorney.

Sure...you can sue as many people as you can afford....................
