Civil suit?


I assisted my elderly neighbor and their family. The neighbor got to the point the family wanted to place him in a facility. He did not want to go. He wanted to bring help into his home to assist him. Somehow the elder abuse people got involved. The children assumed I had contacted them. They then went down to file a restraining order citing that I had abused him. The judge interviewed him and threw the case out.

However, it still sets on my record in the court house and because of the nature of my work I keep failing background investigations. The allegations they made are totally deceptive and have cost me not finding a suitable job for the last 9 months. I'm out of money to support my bills etc. One interviewer told me about it, otherwise I would never had known, as I was never notified.

What if anything can I do. I would like to sue them so they do not ever do this to someone again. I also want it removed from my record completely!

You should probably go and review the court file. There should be an order in the file dismissing the case.

Get a copy to show any prospective lawyers it was dimissed as meritless. If the order is not in the file, talk to the clerk about how to get a copy of the order in the file.

If the judge did not enter a written order, you may have to file a written motion addressed to the judge who heard the case and ask him enter an order sealing the file or taking appropriate action to ensure the record is set straight.

P.S. Of course the best thing to do is consult a local lawyer to see what the best course of action is. If you cannot afford one, there is probably a local legal aid office. They specialize in cases just like this. Good luck
