Instigating a prison sentence?


If this did apply Is there a law against a father and an elder brother instigating a fight to attempt to put one of their sons in prison?

thank you--what they do is force extra meds onto me and then when i refuse they threaten with the force of PIGS i am sorry I mean police

Sounds like a pretty dysfunctional family to me. There is no law with the specificity you mentioned. However, there are laws to as instigating fights.

Not if you DO NOT mention that the instigated fight was a pre-planned event.
But since you did mention it, the son and the father who instigated the fight can or will be charged with aggravated assault and premeditated murder,(Can you prove you were NOT going to kill him,) and sentenced to time to be served in either county jail or prison.
Why would they want their son in prison? It would be easier to just plant drugs on them and call the cops.

No- there is no "law" against that, however I don't understand the details of the situation you are asking about. There may be certain actions that could be considered against the law, however the biological relationship should not play a factor. The main focus would be on the actual act that broke the law. There are no separate laws dedicated to family relation, everyone is treted equally during the legal process.

I would tell you to consult an attorney if you want to have peace of mind about your situation. To join the service you don't have to do anything but pay the monthly $26 payment upfront. Thats all you will be out of pocket for instead of the couple hundred you would be otherwise.

Again, be careful! The downside is this is a multilevel marketing deal, but the good side is that after you need this service you can cancel and only cost you $26! Don't let them talk to into keeping your membership all year- YOU CAN become a member again if you ever need the service again!!!

PS- The best advice you will recieve is from a retained attorney. Nobody on here is an attorney, we don't have a license to practice law in your state. So talk with an attorney before you use any "advice" off here. The attorney for Pre-paid legal are available 24/7/365. They give you a plastic card that you carry with you and give to any police offer if needed. It states your rights and says you have the attorney firm on retainer. It then states that you must be granted access to your attorney immediatley. Depending on the circumstances, the attorney will talk directly to the Police officer and put him in his place.

Depends what you mean by instigating. If two people insult a third, talk to him, tease him, egg him on until he lashed out, the person who got physical is guilty of a crime even if the others planned it that way. If two people physically assault a third, and he simply defends himself with that degree of force necessary to prevent harm (as distinguished from retaliation), then the ones who first got physical have committed a crime but the one who defended himself did not.
