Can the court remove me out of my own house?
My wife moved out of the house a month ago taking my youngest daughter. She left me with the two elder daughters.
She is put in a refuge center now. Can they remove me from the home that i own.And put her in the house.she had me arrested on a common assault. She told the police i dragged her down the stairs which i didnt.She put bruises on her back and said that i did them which i didnt.the police,only gave me a caution. Will all this go against me??

The courts can do anything. And I have seen that happen. Get a lawyer immediately. Divorces coupled with restraining orders can get nasty.

To answer your question - yes! If she is alleging domestic violence and has no where else to go and wants to go home, yes the police will ask you to leave or if she filed for a protective order and asked for her to reside in the home, yes the court can ask you to leave. You need to file a response when you receive documentation and request a hearing.
If the police were called out, they probably filed a police report of some kind. Get a copy. It will show who said what and the outcome. If you were not cited then you do not have to appear for court, but the police report will still be there.

If the courts find in favor of your wife, then yes, they can't put you out of your home so that your wife and daughter have a safe place to live. Custody also is determined by the judge and it all depends on which person he finds more credible: you or your wife.
