Inheritance of Joint property. How?


鈥楳adhav鈥?jointly holds a landed property with his son 鈥楻am鈥? 鈥楳adhav鈥?dies intestate. Ram has one elder brother and one younger brother and a sister. I would like to know whether Ram鈥檚 siblings have any right over the property jointly held by 'Ram' and deceased father?.

This disputed immovable property was held in joint name of Madhav & his son Ram, it means they both were the co-owner of this property in equal share unless there exist any document to prove a different share holding in such property between Madhav & Ram or to show that only Ram/Madhav was the actual or sole owner of this property but name of Madhav/Ram was added in the sale deed or other property papers for just for convenience sake but not for the sake of ownership of such property. After the death of Madhav his share in this property goes to his entire legal heir, i.e. Ram, his two brothers & his sister in equal share. All these four get 1/4th of this 1/2 of the whole property, i.e. 1/8 parts each of this property. So after this partition Ram is owner of 5/8 part of this property & other three are owner of 1/8 part each.

Ram's siblings should atleat have right over the shares of Madav in joint property with his son Ram. How about Ram settling dispute amicably by negotiating and giving money to his siblingsso that property can be at his disposal?

The property is a joint property,after the death of Madhav, his heirs has got legal power to enjoy his property.

US; Joint tenants pass shares of property to surviving tenant without passing thru probate in almost every state.
