Question regarding the possibility of early-release from prison?


Hello! A good friend of mine was just sentenced in CA (non-violent, drug charge, State) for 3 years in State Prison. Because of his clean past, he qualified for a 50% reduction. So at his sentencing he was given 15 months (he did a total of 3 months in county already). I was wondering what might be the earliest time he can get out with good-behavior (not sure if everyone is granted this), if the problem of over-crowding in CA might reduce his sentence, the possibility of work or education, etc. If anyone can help me out with some useful information, I would greatly appreciate it. Thanks in advance for the time.

Your numbers don't work out quite right. If he was in custody for three months, with applicable jail credits he should have been given credit for 4.5 months against a 36-month term. That would leave him with 31.5 months to serve, which could be reduced to 15.75 with 50% credits. There are no early releases from state prison based upon overcrowding, at least not yet. The only additional credits he could earn would be if he qualified for a conservation (fire) camp. Time spent working in a firecamp earns 2 for 1 credit (and it is EARNED), so if he spent all his time there a 31.5 month term could wind up as a little more than 10.

He'll probably be in jail for less then a year as long as he stays out of trouble while in prison. As his friend you should help him get and stay clean so that he doesn't end up there again.

with already a 50% reduction i dont see any other reductions coming up...not everyone is granted good behavior either.
