What are examples of two view points from the court case of Brown vs Board of Education?

The viewpoint of "Board of Education"
"Separate but equal" was the law of the land. It had been challenged and had been upheld by Plessy v Ferguson in 1896. As the issue was decided, and there is nothing new in the current case, the earlier ruling stands.


The viewpoint of Brown. Separate is inherently unequal as the separation is used to insure that Whites have superior accommodations over blacks. There is no equality and therefore a violation fo the equal protection clause.

Of course Brown was right and the supreme court said so in a unanimous decision. What the court looked at was not the doctrine, but the application. They found it egregiously unequal on every level - a clear and convincing string of injustices and therefore violation of the 14th amendment.

Had segregated facilities actually been equal - or even close, Plessy likely would have been sustained rather than overturned. But the court found that the purpose of separate was inequality
