Am I able to sue over this?


Well I'm 17 years old, I live in Miami Florida, and I have been working for a fast food restaurant for about three months now, and according to child labor laws in florida I am not allowed to work for more than 8 hours a day and I'm supposed to get a 30 minute break every 4 hours. My manager has had me work 6 hours without a break, and has had me work 11 hour days multiple times. Child labor laws in florida are as follows:

Minors age 16-17 years of age:

Are restricted from working between the hours of 11 p.m. and 6:30 a.m. on nights prior to a school day

Cannot work more than 30 hours in any one week while school is in session

May not work more than 8 hours or work during school hours, unless as part of a career education program or there is no session of school the following day

Are not permitted to work more than 6 consecutive days in any week

Must take a 30-minute uninterrupted break after 4 hours of continuous work.

I was wondering what can i do about this.

Make a claim with the state labor board. You may be entitled to overtime pay and/or other recovery.

You cannot sue at all, being under the age of 18. Also, you cannot sue for this type of thing. you could have quit your job knowing that they are not following the rules. They must be reported and they can be fined. Contact:

Well, I don't know what your goal is. You got paid? YOU can't sue because you are a minor. I suppose your parents could, if they want that hassle but they would have to show damages. If it's a problem, report it to your local Labor Relations Board and they will be sanctioned in some way, but it's not a situation where you would be compensated, I don't think. It certainly wouldn't be enough to make it worthwhile.

discrimination suit know your rights you stated what is posted they must follow if you feel that you are over worked tell the manger that I can not work this many hours. explain to him or her that I can only work and state the time and days you can work.

Welcome to the working world, kid. Most of us "grown ups" go through worse every day. Think you got it bad now? Wait till you are working 70 hours a week just to get by. What you have now will look like vacation. (Not that I remember what those are.)

You tell your boss he's in violation of the regulations, and that you require the limits provided in law.

He may or may not fire you at that point.

Sue and win what? You'd pay more in lawyer's fees than you could ever win.

If you're being treated like crap, quit.
