Does anyone know if PA considers homeschooling as propable education after 18 and must I pay child support?


She just turned 18. Her mother let her drop out of high school and I had no say in it, and was not aware, nor did I sign a paper. Ex is doing this to keep continuing to get money out of me, how long could she possibly drag out home schooling? And is it legal in PA if she is only getting a "certificate of completion"? Will I still have to pay? From my knowledge her mother let her drop out so she could stay at home and watch the baby she had from another man while we were married. I just think it's not fair. She's online for half of the day, babysitting in between. I also know they both have drug and alcohol addictions, and I hate knowing that my money is to support their habits. I have my hearing in a few days, can I enforce mandatory drug testing since I pay her medical. My ex has been taking everything she can from me for the last 4 years, and I just want to move on with my new life with my new wife, and start living again. Thank you

I looked for this answer, but couldn't find the exact thing you need.

PA allows you to file a petition to terminate support upon the LATER of 1) the child turns 18, or 2) the child has withdrawn from high school.

The question is whether what she is now doing in "homeschooling" can be considered withdrawing from high school.

Couldn't find an exact reference, but my experience tells me that the answer will be found in the accreditation of the homeschooling curriculum. If the program is not considered to be the equivalent of attending high school, then I would argue she has withdrawn. Also, if she is not actually working the program, she has withdrawn.

In any event, PA state officials are required to make an official inquiry within one year of 18th birthday, asking mom to prove that the child is still qualified to receive support because she is still in high school. If they can't prove this, the state terminates support. This section of the law seems to set forth the legislature's expectation that students will complete high school by 19 and keeps you from having to support a 56 year old high school student.

To succeed in a petition to terminate, you need all the information you can get about the homeschool program and your daughter's progress in it. That's what subpoenas are for.

Ask your lawyer and if you don't have one, get one before the hearing. The judge can extend child support payments past 18 for any of a number of reasons. If you can prove any of what you said then you are probably in a reasonable position though once again anything can happen in court.

PROVIDE ALL MEDICAL.AND I STILL HAVE TO PAY HER 110.00 A WEEK FOR CHILD SUPPORT.FIGURE THAT ONE OUT.THEY ARE NOTHING BUT BLOOD SUCKING LEECHES. I HAVE APPEALED MINE TO THE STATE CAPITOL TO HAVE THIS CHANGED.THIS IS EXTORTION.YOU HAVE TO STAND UP TO THEM AND DON'T LAY DOWN AND TAKE IT.GOOD LUCK
