How to file and fight a case against an employer / private school run by a trust?


I want to fight a cast against a private school run by an untrustworthy trust.The school doesnot follow any law of the land but autocratic director formed and broke rules at the drop of his hat, although it is affiliated with state education board.. As no one in the family is supporting me to fight this case, i am left with no money. can i file and fight the case on my own. Is there any society / organisation who may render help to women employees of schools to save them and fight against clutches of these trustees? I want to know about such helps in ahmedabad. please help me fight this injustice. If education empowers...first empower the educators .....!

I doubt you can do much without funding.
Since no one in your family is supporting you in this effort, it might be a good idea to rethink your position.

the school authorities should be given a written complaint . then take the police . but still if if does not work u can case it in the subordinate court but since u r short of money u can do none but wait and watch as alll he adocate ask money for taking up ur case

Be courageous. It seems u are employee of the school.If u want to put the school on right track then write the all illegal practises.Inform to concerned authorities turn by turn.If anyone is not ready to rectify then go to a advocate who can help u without fee. He will advise u to take the next step.

Bring the complaints to the media. The rest will be taken care of by itself.

Certainly remedy are available for wrong doings.You may not file a case in high court as a writ because it is a private trust. you can appeal before the director, education , with your plight. or you can file a case before lower court on ground of breach of contract.Every one is competent to fight his won case in court of law. How ever, it needs some knowledge about court procedure on filing a case and cross exmining witnesses. in hard case you can approach the legal- aid service of your state.

There are three aspects. Employer-employee dispute, forum for the dispute resolution and legal costs. Whatever be the grievances, an employee should neither get intemperate nor desparate. The State education Acts provide for administrative authorities as dispute resolution mechanism, and only after exhausting this remedy or state administrative tribunal, if one exists and has jurisdictionon the said school, the civil court can be approached. Legal services Authority, functioning at the office of the District judge would provide details of free legal assistance. It is better that the issue is agitated through the mechanism of Union/Association of teachers, rather than individual adventurism, which may be costly in terms of time, money and energy and agonising. The ultimate victory should not be overwhelmed by the exhaustion incurred while securing it.
