If your boss harrasses you and you are disabled can you file a complaint with EEOC?


My husband is being harrased by his supervisors they yell at him, and even other employees have joined in. He is bipolar they dont know that but they are aware that he is sick because he has been on FMLA. He has been there 10 years with an excellant record, and has even gotten letters complimenting him on his work and even one for saving a life of an elderly woman. How can they now do this to him. Im also concerned that this is all happening because of the new director. Race has became an issue, one of the supervisiors has been caught saying racist remarks to another supervisor and in a blog on the itnernet a supervisor stated that the black supervisor got her job with no education because she was black he laughed and said that even though she got the promotion she was still wearing knee pads for the white man. This is sick, and never ever had anything like this ever happened before the new director. Can we file a complaint with EEOC? They said he cant he has to go proper chain.

First, run, don't walk to get a lawyer. If you cannot afford one, check to see if there is a law school in your area with a legal clinic that takes on cases like yours. If that fails, contact you local legal aid office for guidance.

With that in mind, there are some things your husband needs to do at work in anticipation of a EEOC complaint. First, you should know that most of the laws that you think are at issue here tend to only apply to employers with 15 or more full time employees. Make sure that is the case for your husband's employer. this may be an easy question, but sometimes it is not. Second, has your husband filed a complaint with his employer about the behavior, specifically with the HR department? If he has not, discuss with the lawyer you get whether he needs to or reasonably can be expected to. Maybe the person to whom he should complain is the person giving him hell...in which case, it may not be an issue that he has not filed a formal complaint. The EEOC will want to know whether there is a complaint procedure at the job and whether he was made aware of it. If he was made aware, they will want to know whether he followed it.

Finally, start keeping a notebook diary of what is going on with specific questions in the notebook to ask your lawyer. If your lawyer asks you for info, put it in the notebook and make sure the notebook reflects that this is btwn you and your lawyer. The disability issue may be much easier to litigate than the race issue, but you need to try to get a lawyer to handle this for you. Don't try to do this alone.

Yes and it's called a Hostile Work Environment. My work-place told me the exact same thing and in the end I did what I had to do. Which was go to outside help and above them all to show who really was in control. Keep all records of times, dates, and each and every incident. Nail them to the wall!!
