How to get power of attorney done in USA for availing educational loan in India ?


Hi,
I need to get education loan in India and im currently in USA. My dad can get the loan for me if he has the POA docs signed by me. The question is, should i go to Indian consulate for POA or any notary from USA can be the witness if i sign the POA in Indian POA format ?

Bank will provide its own draft of the POA. Otherwise get it drafted by a lawyer in India, specifying not only instant need propelled power but also power to cover all contingencies in India, you evisage as likely to arise, requiring your presence and/or your signature, which your attorney can do on your behalf. Get the draft by email, print it out on thick green sheet, sign on all pages, date it in the last page under your signature, notarise it with a notary of USA, i your place of residence/work and trasmit it to your father. It requires to be taken to the Sub-Registrar's office, having jurisdiction over the place of residence of the attorney, alongwith the postal envelope as proof of date of receit in India, stamp duty for POA as applicable in the State to be paid, and endorsement obtained from the Sub-Registrar. It takes about 2 hours and fee will be varying between Rs.50 to Rs.200 in different states. For bank purposes, even without the Sub-Registrar's endorsement, POA can be used. A photocopy will be verified with the original,a ttested and retained by the Bank, allowing the attorey to act.

You are asking the wrong people. Ask the authority that requires the P.O.A. In general India will accept US Notary acknowledgments and US will accept India's. Someone MAY however insist on an Apostille (A Government certificate certifying the Notary's authority).
