Going to get an abortion she has accident, looses baby, other driver at fault can be charged, is this right? |
She is 13, had sex education classes in school, went to State approved agency got free condoms and pills, but decided not to use them. Felt Abortion was her prefered choice after talking to them earlier and was on her way to the appointment she set up to have it done. I think she is morally wrong to have him charged with manslaughter. Sounds like the family found a way to make a quick fortune. My ex did something similar. Disgusting. i dont see why not, it took the "power" out of her hands; what i mean is what if she had made it to the clinic and changed her mind, now she doesnt have that opportunity. but im sure the judge/jury would take that into account She wouldn't have caused so much problems if she wasn't such a slutty whore. Ok, regardless of where she was headed and her intentions at her desired destination...getting hit by a driver and causing the fetus to be killed is a punishable offense. Now, if he has good lawyers, he can get the charge reduced to involuntary manslaughter, based upon the fact that it was a result of an accident. However, the man did not know she was going to get an abortion, and the man did not act maliciously, and did not intend or knowingly commit this offense. At best he should be probated on that offense. Any traffic citations should be issued and taken care of appropriately. Men have been getting the shaft since well before there were gold mines. So this is nothing new to me. The laws vary by state, so there may be 50 ways to answer your question. You should state where you are form in order to get a better answer. Hang on calm down Depends on what state the baby is living in. You used the word baby. Did you mean fetus? Americans do not abort babies. We abort fetuses. If we aborted babies, it would be murder. But we call the moving, growing pieces of flesh fetuses, so that we can abort them without murdering them. If she was on her way to have an abortion, I would assume that she was less than 5 months along. In my state, you have to be 6 months pregnant before the fetus is "legally" considered a baby. Like, if you have a miscarriage at 6 months or more, you will have a death certificate and have to bury the baby. But, before that it is just considered a miscarriage of a fetus. So, I don't really think it matters if she was going to have an abortion or not, it depends on far along she was. Also, it was her choice to have the abortion, right or not, and not the man's choice who hit her. There is much legally irrelevant material here. The fact that the female was planning to have an abortion is completely immaterial, as is the fact that she was on her way to do so. The charge of manslaughter, to be proved, would have to entail at least the following elements: If one interprets the law in the narrowest possible way, the charge of manslaughter is warranted as a life was taken without pre-meditation.
