How can laws that are based upon the assumption that an illegal act will occur in the future be legal or just?

The presumption of assumption is not entirely accurate.

Society sets rules to govern itself in what is considered a civilised manner and, as need for it is seen, enforcement of the rules follows. The latter requires that levels of compliance or non-compliance need to be set.

As regards alcohol, the actual wording varies by State or Province, but the general wording usually says alcoholic drinks are not permitted within reach of the driver. There is usually a second part that says unsealed containers of alcoholic drink are not permitted in the vehicle.

The need for such a law is based on an endless list of precedents where it was seen that those drivers who had alcohol available DID consume it and the consumption led to serious negative consequence.



4 ounces of weed is viewed as being considerably more than any individual needs for personal consumption. From there it flows that this quantity (and above) is usually what is used by those who deal in drugs. This fact has been seen by police and has been demonstrated countless times in courts, thus there is legal precedent for the establishing of what appears to be an arbitrary quantity level, as the need for a control factor which is deemed to be a public necessity demands that some threshhold level be established in law.

Speaking with a prostitute does not constitute soliciting. The conversation moves into illegality when you actually ask her to tell you her price for sexual services, make an offer and/or ask for one or more such services.
In asking for her sexual price list you are indicating you wish to pursue a purchase of service if the price is within your chosen range. You might consider this a presumption, and it is so, however, there is again a countless number of times this has occurred over many, many, years and the demonstrated rate of incidence is what supports the law.

There is also an adage that says: "Ignorance of the law is no excuse", which means you have a legal obligation to know the essence of the law so that you should not knowingly transgress it. Quite evidently, you do know of the mentioned laws.

How does the law assume these some of these things? You cannot get arrested for having a small-talk converstion with a prostitute. You can only be arrested for offering money for sexual favors. There's no assumptions there.

What is against the law about having a beer? I don't get that one. No law stops you from having a beer with your buddy, nor does any law make that illegal. What law are you trying to reference here?

The weed, well you kind of have a point. But the other two make no sense unless you can come up with specific examples.

Just for info, did you happen to see the movie "Minority Report"? If not, better do it and soon. Our society doesn't tolerate drugs, alcohol and anything (other than cell phones for the most part) that interfers with driving a vehicle. In some cases that vehicle is also noted as a "weapon". When you are pulled over for anything, the cops have a right to do a visual check of your car WITHOUT your permission - and if they have probable cause, they will search your auto - they don't even need a warrant to do it because your car is "highly moveable". Cops run the show for the most part - at least for what you did or are doing. The sex business??? It sounds like one doesn't have respect for anything. The stuff you mention - better do it at home!

IF a copper saw your buddy drinking when you were driving the car he wouldn't be much of a copper if he didn't pull you over & breathalise you.
He would be failing in his duty if he didn't do that ,
Also you should have enough sense to tell your buddy NOT to drink in the car, anyway
Can't he wait until you get to the party ?
