What are the consequences for a 3rd DUI in California?


A co-worker of mine has already had 2 DUI's in the past two years. She's stupid and continues to drive drunk. What will happen to her if she gets another one?

I hope they crush and melt her car and put her in prison for a long time.

No one has the right to endanger other people that way.

Depends which county you live in.

The poorer counties won't do much at all, since they neither have the money to prosecute nor the jail space to house her. The more wealthy counties will throw the book at her.

My buddy lives in Humboldt county and has gotten 4 DUIs in 2 years. Still has his license, paid about $20k in fines, didn't serve 1 day in jail. Just went out and bought a $50k pick up truck.

Tell your friend to get a lawyer. He's looking at county jail for at least 120 days and a fine of at least $390. As a bonus, he gets his license revoked. See vehicle code 23546.

Probably won't have a driver's license for a few years. And if she does the car insurance will cost more than her car.
Send her to AA before she kills someone.

In some states it's 3 strikes and you're out.

Here in Michigan I know a 3rd offender that went to jail for 6 mo. a bunch of fines and no license for at least 5 years.

What would Darby do?

3rd strike law....llife in prison!
