How can you avoid jail time or limit it on a 3rd DUi in colorado?


My mom recently got her 3rd DUI. Her first one was 16 years ago. Her 2nd one 2 and her third a couple months ago. I know that drunk driving is horrible but they are trying to send her to jail for 1 year. She is not a bad person she got her DUI's after she lost people really close to her. I am asking if anyone has been through this. Isnt there a statue of limataions since her 1st one was 16 years ago? I appreciate any advise anyone can give.

The first DUI 16 yrs ago should be cleared by now. I think the state see's her as a repeat offender; Two Dui's is bad! Your mom isn't a bad person but she continues to violate the law and that is a crime and she might be doing some jail time. We all make mistakes and we all have lapse in judgement but your mom has an alcoholic problem and she doesn't realize how wrong she is for breaking the law. She could kill herself or other innocent drivers. On top of that this is going to cost her thousands of dollars and Yes, possible Jail time!

Is there a way? - I don't know. A good lawyer might be able to find a way.

Should there be? - No. She decided to drive drunk twice within the last 3 years.

Statutes of limitations limit the time between an act and when a person can be charged with that act. She was already tried and convicted of DUI 16 years ago.

I had an owi on my 21's bday in 1989 and that was wiped out due to time frame. now the dmv keeps all records. I dont think jail is an answer. Maybe counseling is a better choice. Good advise get a taxi or friend to drive.

Statute of limitations doesn't apply here.

Get a good lawyer.
