"Have you ever been convicted of a crime?" Do traffic tickets count?


I am filling out an application to get fingerprinted so that I can be my godsons "daycare" provider. It asks the above question and then says:

You must disclose convictions, including reckless and drunk driving convictions even if:
1: it happened a long time ago
2: it was only a misdemeanor
3: You didnt have to go to court (your attorney went for you)
4: you had no jail time or the sentence was only a fine or probation
5: you received a certificate of rehabilitation
6: the conviction was later dismissed, set aside, or the sentence was suspended

It goes on to say that if I leave anything out my application gets instant denial. I have never gotten in any big trouble, but I have gotten a few traffic tickets. The last one I got was a couple years ago and it was a seatbelt ticket. before that, like in 2005, I totalled my moms Caddy and got a ticket for that. I have tried looking up case info online and cannot find any info on myself (go figure). So what do you think I should do? Do you think I should put my traffic tickets on there? and they want all this info about the "crime" too, like dates and things, and I dont know those!!

I dont remember dates and when I totalled the Caddy I dont remember what they put on the ticket. I'm pretty sure there were 2 charges but I'm SO not sure. I dont wanna mess this up. Should I just wait until I get there and tell them my situation??

The short answer is no.

There are several types of crimes:
Crimes:
Felonies: 1 year and jail and longer
Misdemeanor: Up to 1 year and Jail & $1000 fine

Then there are Non-criminal offenses(do not count as "crimes"):
Violation/Infraction - punishable by fine only or in some cases short jail term(no more then 15 days). Examples loitering, open alcohol container
Traffic Violations - Speeding, running a red light, etc.

If you totaled a car in 05, better fess up. And after that, a seatbelt ticket is a nothing; might as well list it as well. List what you have.

Technically, a traffic ticket is a civil infraction, which does not rise to the level of a "crime." You don't have a conviction unless you were ordered to go to court, charged with something, and found guilty. So in your case, your tickets don't count. However, I'm a firm believer in "better safe than sorry." Your best bet is to talk to someone when you hand in your application and ask them for clarification on that issue. Just tell the truth -- tell them you have a couple of tickets where you did not have to go to court and ask them if you have to report them. Chances are they'll say "No."
