Question on time limit for proceeding with or dismissing divorce when in final stages & you are in counseling? |
We live in a no fault divorce state and we have had our trial date, reached a tentative agreement moments before the trial, an attorney drafted up copy of final divorce decree and one of us already signed. The person that signed is not ready to dismiss the divorce because of fear of going through it again, but doesn't want the divorce to go through, either. I think we need a little more time with the marriage counseling. It is a very good counselor and we have only had 2 sessions. Things have been going so well between us over the last several months and I am sure we can both get on the same page if we just had a little more time to get there. The trial date was Feb. 6 and one of us signed the drafted decree on Feb. 21 but the other refused to sign. I am going to call my lawyer tomorrow and ask him, but was wondering if anyone might know this as I am extremely nervous about what the answer is. It will be hard to sleep tonight worrying about this. I got a letter today from my attorney because he received a letter from my spouse's attorney demanding to know why he never received a signed copy. He wanted to know immediately what, if any, objections we had to his drafted decree. Otherwise, he wanted the signed copy immediately. My spouse has not heard from his attorney since the trial date Feb. 6. Ouch, sorry to hear. This goes back to your husband's passive-aggressive nature which we conversed about in another post. If the settlement is fair to you, maybe just call his bluff and sign the thing. You could always get remarried later. |
