How do you force someone to go forward with divorce in Georgia? |
A friend of mine was served divorce papers by his ex. He responded with an ans and counterclaim. They did the mediation that is required by GA Law, but one of the req is for her, the plaintiff, to draft an agreement that they most both sign and turn in. Now, she is refusing to do so, which is holding the process. Is there a form that forces the person to turn it in. He has tried to file a stipulation to get it moved on trial calender, but clayton county in GA won't even do that w/out the agreement signed by both parties....What advice do you have for him? Get a lawyer & will get done. File a motion for summary judgment, with affidavit attached setting out the facts of the failure to reduce the mediation to writing. The court will set the Motion on the motion docket. It won't necessarily grant the motion, but it will get the case in front of the judge. |
