If my fiance is getting a divorce from a guy in Jail in GA? |
and they have nothing together, but she has a child by me and the courts legally look at him as his father can he put a restraining order against her on my son or is he out of luck. Im about to have my son legitamized with DNA testing and Yes he has 30 days to contest, but its filed as a uncontested divorce which we knew he would do anyway.The lawyer says he can do a Discovery and thats it- it will only delay the divorce by a month or so in which the he sayys the Judge will be pissed for wasting his time especially when were trying to get married and Im about to join the Military. If the child is yours and your fiance'...then there is no claim by the "father" who is in jail. If the courts legally recognize him as the father, he has certain legal rights to the child, you really need to get that resolved Not a thing dna is the no-fail paternity test. Do you have a lawyer. I would assume the military could help you with this |
