Is my local swimming pool gulty of age discrimination? UK question?


I went to my local swimming pool this morning who told me the main pool was closed as it was an "over 50's" session only. Now I got to thinking that if I had demanded to be allowed in (I'm in my 30's) then would they have to let me? I thought there was loads of anti age discrimination legislation brought in about a year ago in Europe which means that they cannot discriminate positively or negatively on grounds of age.

probably not. Theyre not discriminating against you because they still accomodate your needs, albeit not at that specific time. They havent said 'no you cant swim here because youre too young' they've said 'no you cant swim here at this particular time' Besides, to claim discrimination you need to prove that you have been unjustifiably treated less favourably than a suitable comparator (in this case an over 50). I know that the swimming pool I used to use when I swam had sessions similar to yours they had an up to Xyrs session, an X-Y session, and a Y+ session, and loads of general swims where anybody can swim. In either case you havent been treated less favourably because there are opportunities for you to swim, whether with your age group, or in the general swim. Secondly, had an over 50 come to one of your sessions, they would be turned away to, ie. treated the same, and needless to say not more or less favourably.

Don't be ridiculous, would you want to be included in the children's swimming lessons then? And if a man wanted to go to a ladies swimming afternoon?? I think you are being a bit silly, just choose to go another time.

They didn't discriminate against you it was an over 50s session just as they have family sessions and ladies only sessions.

I seriously doubt it - if they had said that they weren't able to let you in because it was a class for under-5's would you have felt the same?

most swimming pools have set times on swimming as they have lots of different activity's going on like
early bird swimming
learners swimming
water aerobatics
over age
under age 12-16
then ats open to everyone after all the activity's ended

It's the same at my local pool, there are sessions for over 50's, women only, under 5's or swimming lessons, what if a man between the ages of 5 and 50 who can already swim wants to go? They have to wait until the pool is open to everyone. Most of the time when it is open for everyone, it's at really awkward times so if they work they can never go swimming. However, I don't think there is anything we can do since we're too insignificant to even have our own swimming session. Your best bet would be to speak to citizens advice and see what they think. Nope. Same way in that there are ladies only gyms etc..... As long as the business is seen to offer a balanced schedule that is......if it were only over 50's all day every day then you would have cause to complain. Unless its a private business of course.....in which case they can do what they want!

Darling go to another pool. People really appreciate having an alloted time when they can feel comfortable, like women only sessions for shy or cultutral reasons are appreciated or children sessions for lessons so adults avoid so children sont bug them oap ones for older people so they dont feel slow against show off younger people. Next time check the pool times and lessons. I dont see it as discrimination as it is a paid service not a free entitelment.

Not a leg to stand on, I'm afraid! You would have to then be permitted to attend Ladies only sessions, Mother and Toddler sessions and local team training sessions!

Age discrimination legislation applies to employment and is there to protect people from being discriminated against in the workplace, not for this. I hardly think this is worthy of the European Court of Justice's time. Do you? Go another day or find another pass time.
