Is it Discrimination to not hire because the person is 50 years old and is a biker with tattoos, etc? |
I'm working a research papers that help identify discrimination in the work place and was asking for help to indentify discriminiation. The age thing might be, but if it is a position that requires interaction with the public, and biker tats are not the image that the company wants to project, it is not discrimination. If the qualities or aspects of a person that cause you not to hire that person are not related to their ability to perform the job, it's some form of discrimination. It may not be a form of discrimination that is prohibited by law, but it is discrimination. Age yes, rejecting people with tattoos is not. Discrimination of any kind is when a lesser qualified person gets the job- so the answer depends on the pool of applicants. "Qualified" is a discretionary privilege for employers, unfortunately one that has been abused. Technically a company cannot discrimate because of age, race, or religion. Age may be a plus when hiring because the person may have more knowledge in a specific field. And since when would being a different color affect your performance (even if the color is ink)? |
