Is is discrimination to not hire A person in a wheel chair has bad attitude and thinks every1 discriminates?


I'm working on research papers on identifying discrimination and need help

Of course it's discrimination. Whenever I interview two candidates for a job, and I hire one and not the other, I am discriminating. The legal-ethical question here is whether it is unlawful or invidious discrimination.

If the person in question can prove that the discrimination was based on his handicap--an unlawful ground UNLESS it's a bfoq--then he will win. But the defense is that we didn't hire him because he has a bad attitude and he would chase away customers, the handicapped one gets bupkes.

If you are looking for the legal concept of unlawful discrimination, then you should google "civil rights act." Handicaps are actually a recent addition to the "protected classes" that are covered by the Civil Rights Act, and if you're researching discrimination, you should get better grades if you cover the whole subject.

If the reason is the wheelchair, yes.

If the reason is the attitude, no.

This isn't rocket science...

If someone has a bad attitude, it's not discrimination to not hire them. If they're not hired because of the wheelchair, that's discrimination.
