Should a 48 year old ex-wife who has never worked, and has a learning disability get Spousal Support?


She wants to go back to college, but it is very hard for her. When she was going to school, she was getting bad grades. In general, it would take her probably twice as much as ordinary people to get a degree. What is the probability that she would get Spousal Support and for how long? She is my sister and she has a lawyer. Her lawyer doesn't give her definite answers. They have been married for 18 years.

She needs a different lawyer - one that specializes in Social Security Disability. They usually work on a contingency. She should file for disability - you can help her with that, After she get her first notice of
rejection (which she is 99% guaranteed to get), her SSD lawyer will take over and appeal.

She may be able to get spousal support for a limited time. That is, if she can get it to court, have the judge sign off on it and then, trust him to pay up.

If she has no work history and little formal education, she should get Spousal Support. A good lawyer should be able to win that for her in a divorce, but a judge may award it with a specific cut-off such as when she begins to be self-supporting.
