Can an individual be terminated or fired from a job who on temporary disability for job abandonment?

Can an individual be terminated or fired from a job who on temporary disability for job abandonment?

Most states are employment at will states, meaning the employee or the employer has the right to terminate the employment agreement without notice or reason. So yeah they can terminate you for just about anything. Did the person work their long enough to apply for FMLA (Family Medical Leave Act). If so then the employer can't fire them as long as they are on FMLA leave for the temporary disability. Hopefully, they can file for unemployment if they worked their long enough.

If it is a disability not caused by the job and a disability described by only a doctor, yes. The employer needs people to fill the position.

No.

There are federal laws against termination based on the use of family / medical leave. These laws may not apply to certain small businesses (under 30 employees), but otherwise you should be protected against wrongful termination.

Of course, they can. The job goes on and needs to be filled by someone capable of doing it. Sorry.

yes but not legally

contact HR they will tell you what you need to know.
