Child Support Until 21, If There's A Order Of Protection & On Disability?


My Mother Is On Disability, As Her Only Income, She Has Filed For An Order Of Protection Against Me (We Go To Court In The Morning To See If She Get's It) I Haven't Put My Hands On Her So We Sha'll See.

Right Now I'm Living On A Homeless Shelter & Every Bit Of Money Helps, I'm 19...I'd Like To Get Child Support From Her, But With The Order Of Protection Pending & Her Being On Disability I'm Not Sure If I Can...Can I?

With The Order Of Protection?
& With Out It?
& The Disability?

I Should Add I'm In New York & In NY Parents MUST Take Care Of Their Kids Until Their 22nd Birthday.

Yes you can get child support while there is an order of protection or restraining order. That just means you can't "see" each other. You can pay support for someone that you cannot see. Messed up, I know, but true. So this order of protection really has absolutely no bearing on if they will award child support.

Yes you can get support from someone on disability. The calculation will be different, it will not be the 17% that it is in NY for one child, they will make an allowance for the fact that she is literally unable to work, but it will still be something, and it will be garnished from her diability check. The fact that you are also on disability will also make a difference in what she will have to pay, depending on how much the each of you recieve. So yes, you can, and yes they will make her.

If you are over 18 you get nothing. If you were a full time student you might be able to get child support. But I have never heard of child support being rewarded directly to the "child" child support goes to the parent that is supporting the child.

You need to get a job and go back to school. Stop trying live off of people.

they MUST not unless the child is in school, and then its only if the child lives with the parent, in which case the non custodial parent pays the other parent child support. if you no longer live at home then you are on your own. get a job like the rest of use and contribute to society.

"A parents liability for the support of his or her children is limited to children under the age of 21 years. In the absence of an express or implied contract, parents have no duty to support an adult child. For custody, visitation and other purposes, the age of majority is age 18, but for purposes of the parental support obligation the age of majority remains at 21. The mutual parental duty of child support is not absolute. It may be suspended or terminated before the child is 21 if the child becomes emancipated by becoming economically independent of his/her parents through employment, by marriage or entry into the military service. Under unusual circumstances, a child may be deemed emancipated if he/she is guilty of outrageous misbehavior, such as makes it inequitable to enforce the support obligation, or if without cause, he/she withdraws from parental control and supervision."

that last part applies to you. so just because you dont like the answers doesnt mean that they are worng. You woudnt be homeless if you got a job. how do you think everyone else has a place to live?

Your over 18 buck up and be an adult u are no longer ur mothers responsibity. Get a JOB. I think that it absolutly pathetic of you to even think about sucking up ur mom s little bit of income.
